TheTreehouse.Shop – General Terms and Conditions (GTC) – with Shopify additions
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via our online shop www.thetreehouse.shop. Our shop is aimed at both consumers and entrepreneurs (B2C and B2B).
A consumer within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

The product descriptions in the online shop do not constitute a binding offer in the legal sense, but rather an invitation to place an order.
By clicking on the ‘Submit order’ button, you are placing a binding order for the goods contained in the shopping basket. We will immediately confirm receipt of your order by automatic email.
The contract is only concluded upon dispatch of the goods or by our express declaration of acceptance.

In the event of technical disruptions in the ordering or payment process, we reserve the right not to accept an order. A contract is only concluded upon our express acceptance.
3. Contract language, contract text storage
The contract language is German (EN, ES, FR, IT translations by DeepL are also available).
The contract text is stored by us and can be viewed by you via your customer account.
4. Delivery

5. Terms of payment
5.1 Prices
All prices include statutory value added tax.
5.2 Payment
We offer the following payment methods:
Via Shopify Payments: Shop Pay, Visa, Mastercard, Maestro, Apple Pay, Google Pay, Bancontact, BLIK, EPS, iDeal, Klarna (all payment methods offered by Klarna)
Via Mollie: iDeal, Bancontact, SEPA transfer, SEPA direct debit, PayPal
Payment processing is carried out by the aforementioned third-party providers (Shopify Payments, Mollie & PayPal). Your payment details are not stored by us, but are processed securely directly by the payment service providers.
Additions (Shopify):
In the event of technical problems during the payment process (e.g. disruptions at Shopify Payments, PayPal or Mollie), we reserve the right to suspend or reject the order. Chargebacks without prior contact may result in additional processing fees.
6. Warranty and guarantees
The statutory warranty rights apply.
Addendum:
Refunds will only be made via the payment method used for the payment.
7. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before consumer arbitration boards.

We are not obliged to participate in dispute resolution proceedings on the Shopify platform.
8. Advice and disclaimer
We sometimes receive texts, photos and videos from our customers, which we use for consultation purposes prior to the conclusion of a purchase. This advice and recommendations are provided with professional competence by Vitus Wahlländer (civil engineer, carpenter's assistant, treehouse builder), but are non-binding, without any structural or static binding character and expressly without warranty.
9. Quality, safety and liability for hardware
We place the highest value on quality, reliable information and honest, transparent dealings with our customers. Please read the following information carefully before purchasing our products:
Liability – use at your own risk:
The buyer bears full responsibility for the installation and use of our products. We – Vitus Wahlländer / TheTreehouse.Shop – accept no liability for damage to trees, buildings or persons. Our products (treehouse screws and accessories) do not have official structural approval; all load specifications are non-binding guidelines with a safety factor > 2.
No influence on environmental and tree factors:
We have no influence on individual tree health, wood properties, soil conditions, storms, pests, extreme weather or other environmental factors that may affect the safety of the fastenings. These circumstances are known to the customer and cannot be foreseen or influenced by us.
Maintenance and inspection:
After extreme weather, after peak loads and at least once a year, the condition of the fastenings and the health of the tree must be visually inspected. If in doubt, do not enter the treehouse and consult a qualified professional immediately.
Quality guarantee:
Our products are ‘Made in Germany’ (Bavaria, Schliersee) and are manufactured by trained specialists. They have proven themselves in professional treehouse construction for decades. We strongly advise against using homemade or technically inadequate fasteners, as even small manufacturing errors can have serious consequences.
Professional assembly:
The products must be assembled correctly. For public buildings, large construction projects, exposed locations (e.g. over 5 m (16.4 ft) high, storm-prone or snow-prone regions), we strongly recommend consulting experts (structural engineers, tree surgeons, master carpenters).
10. Assembly tool rental
We rent out assembly tools (drill, ratchet) in a tool box (approx. 14 kg). The return conditions and further information can be found on the respective product page and are subject to change. The customer undertakes to handle the tools with care and to return them on time. In the event of loss or damage, we reserve the right to demand appropriate compensation.
11. Contractual communication / electronic communication
Communication is mainly electronic, for example by email. By placing an order, you agree to this method of communication.
Addendum (Shopify):
Communication can also take place via the Shopify platform and is considered proper.
12. Retention of title
The goods remain our property until full payment has been received.
13. Copyright and image rights
All texts, photos and videos used on our website, in marketing materials, social media, emails and other advertising materials are subject to copyright.
Customer images and videos:
As part of the annual ‘Treehouse Builders Competition’, participants expressly grant us the right to use submitted photos and videos on our website and in advertising materials.
Careful handling and consultation:
We do not use customer images without prior express consent. The copyright remains with the customer. We act exclusively in consultation with the copyright holders. In the event of complaints or objections, customers can contact us at any time at info@thetreehouse.shop. We will remove the content immediately.
14. Customs and import regulations
For deliveries outside the European Union, customs duties, taxes and import duties may apply, which are to be borne by the customer.
15. Disclaimer for shipping and product liability
We accept no liability for damage caused during the shipment of our products (e.g. injuries when opening the packaging). Likewise, we are not liable for accidents caused by heavy screws or accessories falling down.
Addendum (Shopify):
We are not liable for technical failures or errors on the Shopify platform that lead to delays or incorrect orders.
16. Severability
Should any provision of these Terms and Conditions be or become invalid, the remaining provisions shall remain unaffected. The invalid clause shall be replaced by a provision that comes closest to the economic purpose of the invalid clause.
17. Languages of the Terms and Conditions
These General Terms and Conditions are available in the following languages: German (original), English, Spanish, French and Italian.
18. Data protection & cookies
We process your personal data in accordance with our privacy policy [see checkout]. We use services from Shopify, Mollie and Klarna, among others, which also process your data for payment processing and order fulfilment.
